Introduction

The following Privacy Policy has been written in legal language, so we understand if it’s a bit “heavy” to read. At Air Design we understand that our users and customers can come from any corner of the world, so we have adapted the way we do business to be compliant with GDPR, CCPA and in general most legal instances. However, if you have any doubts please read the complete policy and do reach out to us if you have any questions.

It is important to note that even if you do not read the whole policy by continuing to use our Site and services/products you agree to all the terms explained below. Also, it means you understand your rights and are aware you may exercise them at any time.

Definitions

Air Design
Design means Air Design LLC., 4660 North Ave., Oceanside, California, 92056, USA.

Air Design operates http://airdesignusa.com, http://airdesignusa.com, http://airdesign.com.mx and http://airdesignofficial.com (the "Site"). This page informs the Users of the policies regarding the collection, use and disclosure of Personal Information received from the users of the Site.

We use the User's Personal Information only for providing and improving the Site. By using the Site, the user agrees to the collection and use of information in accordance with this policy.

Personal information collected from minors

A minor constitutes any living individual under the age of 18 years old.

Air Design does not collect information from minors since its products and services require the User to be of legal age.

How we use the personal data

Air Design uses the collected personal data for various purposes:

  • To provide the User with products and services
  • To notify the User about changes to the services and/or products
  • To provide customer support
  • To gather analysis or valuable information so that Air Design can improve its services
  • To detect, prevent and address technical issues

Communications

Air Design may use the User's Personal Information to contact them with newsletters, email advertisements, marketing or promotional materials and other information that may be related to the User´s activity within this Site.

Log Data

Air Design collects information that the User's browser sends whenever the User visits the Site.

This Log Data may include information such as the User´s computer Internet Protocol ("IP") address, browser type, browser version, the pages of our Site that they visit, the time and date of the visit, the time spent on those pages and other statistics.

In addition, Air Design may use third party services such as Google Analytics or other data analysis tools that collect, monitor and analyze this Log Data to gather analysis or valuable information so that it is possible to improve the services, to detect, prevent and address technical issues.

Legal basis for collecting and processing personal data

Air Design´s legal basis for collecting and using the personal data described in this Privacy Policy depends on the personal data that is collected and the specific context in which the information was collected. Some of the legal basis include but are not limited to:

  • Air Design might needs to perform a contract with certain Users (for example: Authorized Dealers)
  • The User has given Air Design permission to do so
  • Processing the User's personal data is in Air Design’s legitimate interests
  • Air Design needs to comply with the law

The right to access

Within the “Exercising Access, Data Portability, and Deletion Rights” from the CCPA the User has the right to request that Air Design discloses their individual information that has been collected within the last 12 months while using the Site. Once Air Design receives the request, it must be responded within 45 days of receipt. The personal information Air Design collects, and which will be disclosed is:

  • All categories of personal information
  • Sources for the personal information that was collected
  • Air Design’s business or commercial purpose for collecting the information
  • Specific pieces of personal information Air Design collected, also known as “data portability request”.

Only the User or a designated and authorized person in the California Secretary of State will be able to make a request. Air Design will not be able to respond to the request or provide the personal information if Air Design cannot verify the identity or authority of the User making the request.

In order to make a request the User is not required to create an account with Air Design but the requests made through an account created in the Site are considered to be verified and associated to the account from which the request is being submitted.

Air Design will only use the personal information provided in a request to verify the identity or authority of the User from which the request is being originated.

Personal information Air Design has sold or disclosed for business reasons

Air Design does not sell or disclose the personal information collected from its Users within the Site.

Data protection rights

If the User is a resident of the European Economic Area (EEA), the User has certain data protection rights. If the User wishes to be informed what personal data Air Design holds about them and if they want it to be removed from the systems, please contact Air Design at sales@airdesingusa.com.

In certain circumstances, the User has the following data protection rights:

  • The right to access, update or to delete the information we have on you
  • The right of rectification
  • The right to object
  • The right of restriction
  • The right to data portability
  • The right to withdraw consent

Security

The security of the User's Personal Information is important to Air Design, but the User must remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While Air Design strives to use commercially acceptable means to protect the User's Personal Information, Air Design cannot guarantee its absolute security.

Air Design uses "cookies" to collect information. The User can instruct its browser to refuse all cookies or to indicate when a cookie is being sent. However, if the User does not accept cookies, the User may not be able to use some portions of the Site.

Retention of personal data

Air Design will retain the User´s personal information only for as long as is necessary for the purposes set out in this Data Protection Policy.

Air Design will retain and use the User's information to the extent necessary to comply with the legal obligations, resolve disputes, and enforce our policies.

The right to non-discrimination

Air Design will not discriminate the User when exercising the corresponding rights described in the CCPA. Such acts of discrimination include:

  • Deny of any goods or services
  • Charging different prices or rates for any of the good or services, including through granting discounts or benefits or through imposing penalties.
  • Provide a different level of quality in any of our goods or services.
  • Suggest that a different price or rate will be offered, or a different level of quality will be given within the products or services.

Nonetheless, it is possible that Air Design may offer a financial incentive permitted within the CCPA which will result in a different price, rate, or quality level. Any incentive permitted within the CCPA and offered will be related to the personal information’s value and contain written terms and conditions from which the User can opt-out or refuse at any time.

Changes to this privacy policy

This Privacy Policy is effective as of August 13, 2021 and will remain in effect for the following 12 months from the date previously mentioned

Air Design reserves the right to update or change the Privacy Policy at any time and the User should check this Privacy Policy periodically. The continued use of the Service after Air Design posts any modifications to the Privacy Policy on this page will constitute the acknowledgment of the modifications and the consent to abide and be bound by the modified Privacy Policy.

If Air Design makes any material changes to this Privacy Policy, Air Design will notify the User either through the email address provided, or by placing a prominent notice on the Site.
